TWNIC Domain Name Registration Management Regulations
Chapter I General Provisions

1. These regulations are provided by Taiwan Network Information Center (TWNIC) for enhancement of the domain name registration management and service standards in Taiwan.

2. Domain name referred to herein shall mean domain names whose top level is .tw and all domain names at lower levels.

3. Names and users of sub domains.

(1) Specific English domain name
Names and users of Level 2 domains by attributes:
a. edu.tw: education and academic institutions
b. gov.tw: government agencies
c. com.tw: private sectors
d. net.tw: ISPs
e. org.tw: incorporated businesses or registered organizations
f. mil.tw: military agencies
g. idv.tw: individuals

(2) Specific Chinese domain name

Names and users of Level 2 domains by attributes:
a. 教育.tw: education and academic institutions
b. 政府.tw: government agencies
c. 商業.tw: private sectors
d. 網路.tw: ISPs
e. 組織.tw: incorporated businesses or registered organizations
f. 軍事.tw: military agencies

(3) General English domain name: Level 2 English domain name regardless of attributes.
(4) General Chinese domain name: Level 2 Chinese domain name regardless of attributes.


4. Domain name specifications
(1) Byte Specification
a. General and specific English domain name:
(a) Applicable bytes include 26 alphabets of both cases, numbers from 0-9, and linking signs (-). The first and the last byte must both be an alphabet or number. No special RFC-1053 signs are allowed.
(b) Byte length: between 2 to 63 bytes.

b. General and specific Chinese domain name:
(a) Applicable bytes despite Chinese characters include 26 alphabets of both cases, numbers from 0-9, and linking signs (-). No double-byte Chinese characters and special RFC-1053 signs are allowed.
(b) Byte length: 4 bytes (with no less than 1 Chinese character) minimum, and 14 Chinese characters or 28 bytes maximum.
(c) Only utf-8 Chinese code is accepted.

(2) Reserved Character
The TWNIC may reserve characters for domain name and post them on the TWNIC Website for public inquiry.

5. Registration agency referred to herein shall mean agencies offering domain name registration service licensed by the TWNIC. The list of registration agencies will be announced on the TWNIC Website.


Chapter II Application and Approval Procedures of Registration

6. Domain name registration is ruled on the FIFO basis.

7. An applicant may apply for domain name registration to a registration agency according to the type of domain name and requirements of application.

Requirements of application:
(1) Specific English domain name:
a. edu.tw: registered education and academic institutions, through the Ministry of Education.
b. gov.tw: legally erected government agencies, through the RDEC, Executive Yuan.
c. mil.tw: legally erected military agencies, through the Ministry of National Defense.
d. com.tw: company incorporated under the Company Law and business registered under the Business Registration Law
e. net.tw: holders of Class 1 telecommunication operator license or network construction (erection) permit or Class 2 telecommunication operator license.
f. org.tw: corporations or foundations incorporated by law.
g. idv.tw: ROC nationals verified through e-mail.

Applicants apply for com.tw, net.tw and org.tw shall submit a domain name review report and corresponding certifications of qualification.

(2) Specific Chinese domain name:
An applicant must have a corresponding registered specific English domain name in Taiwan. In addition, each specific English domain name must correspond to only one specific Chinese domain name.

(3) Universal English domain name (pending).

(4) Universal Chinese domain name

Companies, businesses or corporate bodies registered by law or ROC nationals may apply for a universal Chinese domain name. Nonetheless, a verification of status through e-mail is necessary.

8. An applicant shall complete an online domain name application agreement in an application for domain name registration.

9. Applications of overseas companies or organizations should be made through an ROC law firm. The following documents should be submitted:
(1) Photocopy of the attorney-at-law license.
(2) Power of attorney of the applicant.
(3) Chinese description of client.


10. A registration agency may specify the duration of document approval and related charges. Nonetheless, all registration approval procedure shall be completed within 25 days.

Chapter III Registration Fee

11. The charge for domain name registration service shall cover registration fee and management fee. An application shall pay the registration fee once and in full at the application and the management fee for each application and application for renewal.

12. The charge of the registration agencies shall not exceed the approved registration and management fee announced in the TWNIC Website.

13. Unless otherwise stated by law, no refund of registration fee for any reason is allowed after the registration.


14. The applicant is entitled the right to use of the domain name from the date of payment of registration and management fees within a term of 90 days. A registration agency will notify the applicant to pay the management fee by e-mail. When the domain name validity expires and the applicant fails to pay the management fee, the registration agency may liquidate the use of the domain name and cancel the domain name when the applicant fails to make the payment within the next 90 days.

Chapter IV Settlement of Disputes

15. The applicant agrees that all disputes between a third party arising from or in connection to the domain name shall be settled in accordance with the TWNIC Domain Name Dispute Settlement Procedure and the Rules for Implementation of TWNIC Domain Name Dispute Settlement Procedure.
Such an agreement shall not deprive the parties concerned to seek solutions through legal actions.

16. The applicant may apply for an assignment or cancellation of its domain name, except for disputes as stated in Article 14 of the Disputes Settlement Procedure.

17. Both the applicant and the assignee shall submit documents stated in Article 7 and an assignment agreement in an application for domain name registration assignment.

18. The applicant shall submit documents stated in Article 7 in an application for domain name registration cancellation.

19. The TWNIC shall assign or cancel a domain name in accordance with the decision made by the dispute settlers.

20. The TWNIC may cancel the domain name when an applicant shall violate the Regulations and/or related rules.


Chapter V Applicability and Amendment of the Regulations

21. The TWNIC reserves the right to interpretation of the Regulations.

22. The Regulations shall be implemented after announcement by the TWNIC, and the same to any amendment thereto.



Domain Name Application Agreement


We (institution)/I (individual) hereby apply for domain name registration to the TWIC or its licensed registration agencies (Registrar) and agree to observe the terms and conditions set forth hereunder.
1. The Applicant shall inform the Registrar of an application for, application for renewal of, and application for change of a domain name, and shall ensure the integrity of the following items. The Applicant shall be in full liability for the infringement of any right and benefit of a third party.
(1) All entries in the application shall be complete and true.
(2) According to the Applicant’s knowledge, the domain name for which the Applicant applies shall be free from infringement of any right and benefit of a third party.
(3) The Applicant shall not register and/or use such domain name for improper purposes.
(4) The Applicant shall not register and/or use such domain name with any intentional violation of any law and order.

The Registrar reserves the right to cancellation of such domain name in accordance with Article 7 of this Agreement when the Applicant shall break any of the aforesaid items.

2. The Applicant agrees not to claim for any consequential damages to the Registrar when it fails to update its contact data including e-mail and mailing addresses which that the Registrar shall be unable to notify it of any related information in time.

3. The Applicant agrees to offer to open query the Chinese and English data (domain name, applicant name, telephone number, fax number, e-mail address, date of application, expiry date, DNS setup data) in the WHOIS database.

4. The Registrar warrants to protect the data furnished by the Applicant with the greatest efforts within the reasonable human control and not to disclose any data to any third party without any proper reason, except for online open query by entry as stated in Article 3.

5. The Applicant agrees to offer to the TWNIC the data in the domain name registration management database for use in various domain name experiments.

6. The Applicant agrees that all disputes between a third party arising from or in connection to the domain name shall be settled in accordance with the TWNIC Domain Name Dispute Settlement Procedure and the Rules for Implementation of TWNIC Domain Name Dispute Settlement Procedure.


7. Violations of this agreement, the Domain Name Registration Management Procedure and/or other related law, orders and ordinances shall deemed a breach of this Agreement. The TWNIC may request the Applicant in writing or e-mail to explain the cause(s) of violations, and may cancel the Domain Name registered when the Applicant fails to submit any physical evidence to prove its innocence in writing within 30 days from the receipt of such request. The Registrar’s inaction to the breach of the Applicant shall not imply the Registrar’s approval of any such acts.

8. The TWNIC reserves the right to amendment of the Domain Name Management Procedure subject to physical changes of situation. The TWNIC shall announce all amendments thereof in the TWNIC website or notify the Applicant by e-mail. The Applicant shall notify the TWNIC in writing to delete the domain name registered from the domain name registration management database when such amendments are unacceptable. No objection to such amendments shall deemed an acceptance thereof.

9. Matters not provided herein shall be subject to other applicable laws, orders and/or ordinances. Matters not provided in other applicable laws, orders and/or ordinances shall be subject to the balance of interests with reference to the international practices regarding domain name registration.
