I. Qualifications of Domain Name Registrars:

1. A Registrar shall be a company duly incorporated under the competent laws and having a paid-in capital of at least New Taiwan Dollars 10,000,000, or a juristic person or institute such as association of enterprises, association of common interests, academic association etc., duly established under the competent laws and having a business related to Internet services.

2. TWNIC shall reject such a candidate, if it is an incorporated juristic person and if any of its directors, auditors, managers or shareholders with least 5% of issued shares commits any of Items 1 to 5 of Article 30, the Company Law of Taiwan, the Republic of China.

II. Time to file an application:

An application for Domain Name Registrar may be filed at any time.

III. Filing of Application:

Applications shall contain a written proposal and related documents and shall be submitted to the "Department of Domain Name Services" of TWNIC, after a date to be announced, by postage service (mailing date shall prevail), by courier service or in person.

IV. Required Documents:

1. If the candidate is a corporation established under the laws of Taiwan, the following documents shall be submitted:

a. Registration certificate for profit-seeking enterprises or business registration certificate.
b. Certificate of paid-in capital for over New Taiwan Dollars 10,000,000.
c. Copies of VAT return and receipt of VAT for the past 4 months.

All these documents shall be printed (copied) in A4 size with corporate seal and seal of its representative person.

2. If the candidate is a juristic person or institute having a business related to Internet services, a copy of its registration certificate of juristic person, printed with its corporate seal and seal of its representative person, shall be submitted.

3. If the candidate is a non-Taiwan corporation, institute or juristic person, a certificate supporting such a position in compliance with its national law shall be submitted.

4. 20 Copies of written proposal.


V. Preparation of Documents:

Documents of an application shall be prepared in the following manners. The candidate shall sign or chop on each page and seal the documents in the envelops provided by TWNIC. If any document is missing or incomplete, the candidate shall be deemed not qualified in that application.

1. Envelop for Certification Documents:
Certification documents and materials as provided in Section IV shall be complete, clear and identifiable, one copy for each, with every page of the documents being printed with candidate's corporation seal and seal of its representative person.

2. Written Proposal:
The written proposal shall be packed in batch, each batch with 20 copies, and delivered to the "Department of Domain Name Services" of TWNIC by postage service, courier service or in person.


VI. Examination:

The applications will be examined by the "Domain Name Committee" of TWNIC.

VII. Notice of Allowability:

Results of examination shall be notified to candidates separately with a letter and the name list of qualified candidates will be announced at the website of TWNIC: http://www.twnic.net.tw.

VIII. Guaranty Deposit:

1. A qualified candidate shall enter into an authorization contract with TWNIC and provide a guaranty deposit within fourteen (14) days from the approval of its application.

2. Guaranty Deposit:
A casher's order (promissory note), a crossed bank check or a crossed, certified bank check, payee: "Taiwan Network Information Center", with the amount of New Taiwan Dollars 1,000,000.

3. First year software maintenance fee and technical service fee:
A casher's order (promissory note), a crossed bank check or a crossed, certified bank check, payee: "Taiwan Internet Information Center", with the amount of New Taiwan Dollars 180,000.

4. The guaranty deposit shall be returned in accordance with the contract between TWNIC and the Registrar, unless otherwise provided in the contract. Refund shall be made in written.

5. If a qualified candidate commits any of the followings, its guaranty deposit and interests thereof shall not be returned:

a. Assigns its Domain Name registration services to a third party.
b. Submits a false or incorrect written contract or other documents relating to its performance of the contract with TWNIC, as being revealed.
c. Fails to perform its contract with TWNIC without any reasonable cause.
d. Is terminated or canceled its contract with TWNIC due to reasons attributable to such candidate.
e. Fails to perform a part or the whole contract between it and TWNIC within a deadline provided in the contract or specified by a judicial branch.
f. Materially delays its performance of the contract between it and TWNIC due to reasons attributable to such candidate.
g. Is unable to continue to perform its contract with TWNIC due to bankruptcy or other severe situations.
h. Fails to extend the effective term of the guaranty deposit in accordance with the contract between it and TWNIC.
i. Commits any other breach under the regulations of this document.

IX. Miscellaneous:

1. A candidate qualifying the requirements for a Domain Name Registrar shall not start to provide its Domain Name registration services before it passes the "Domain Name Registration System" tests under the conduct of TWNIC.

2. The following guidelines serve for reference: "TWNIC Guidelines for Authorization of Domain Name Registration Services", the standard "TWNIC Domain Name Registrar Authorization Contract" and the "Reference for the Preparation of Written Proposal in Applying for a Domain Name Registrar, TWNIC".
